Abstract
This work is aimed at determining whether offences included in articles 196 C and E of Law No. 18.290 of the Traffic Law are, actually, crimes of abstract danger or not, considering the severe criticism these legal aspects arise in general. The author is focused on reinterpreting these crimes as real danger, the only way to respect the principle of injury.
