Legislation and jurisprudence about personal care of the child and directand frequent relationship with him/her

Abstract

Amongst the family matters heard by the courts, the great percentage corresponds to the causes related to the personal care and the direct and frequent relationship. This is due to multiple reasons, among which there is the increasing rejection of the youth to the commitment that implies marriage; the equality not only regarding rights, but also regarding the number of children born within and outside the marriage, and the high percentage of divorces. In this article, I will refer to what our legal system states about this matter, as well as its jurisprudential application. I will also mention some legislation and comparative jurisprudence.
